Please carefully read all of the following terms and conditions since this Terms of Use Agreement (“Agreement”) will form a legally binding agreement between you and 13518221 Canada Inc. (“Aesthete Genius”, “we” or “us”). By using this website, social media account or mobile application (the “Platform”), including any of the content contained on the website, account or application such as articles, publications, profiles, information, data and other materials (the “Content”) in any way, including by browsing the Content, using information contained on the Platform and/or submitting information to Aesthete Genius through the use of the Platform, you agree to and are bound by the terms and conditions contained in this Agreement.

From time to time, we may update this Agreement. Your use of the Platform after we post any changes to this Agreement constitutes your agreement to such changes. You agree to review this Agreement periodically so as to familiarize yourself with the version that is in effect at the time.

Aesthete Genius may, in its sole discretion, prevent your use of the Platform without notice to you. You agree that Aesthete Genius will have no liability to you if the Platform is discontinued or changed or if your access to the Platform is terminated.

You acknowledge that you have read and understand and agree to be bound by this Agreement. You represent that you have the legal authority to bind yourself or any party you represent to this Agreement.

You may not use the Platform for any unlawful purpose or for any purpose that is prohibited by this Agreement.

Not medical advice

The Content provided on the Platform is for informational purposes only and does not constitute professional medical diagnosis, advice, treatment or care nor is it intended to be a substitute for professional care. Any visual depictions of a potential skin care treatment for a particular user of the Platform are intended to be for illustrative purposes only and any actual treatment and results obtained may vary depending on the advice received by the user from a licensed health care professional. No practitioner-patient relationship

The presentation of Content on the Platform or your interaction with Aesthete Genius over the Platform does not, by itself, create a practitioner-patient relationship between you and Aesthete Genius and is not intended to solicit you or any other individual to become a patient or client of Aesthete Genius.

Although the Platform may allow you to contact us through email or other means, the Platform is not intended to be a means for users to create a professional-client relationship or for a user to solicit or receive medical or health-related advice. We undertake no responsibility to respond to inquiries made through the Platform.

No endorsement

Unless we specifically state otherwise, we do not recommend or endorse any specific brand or provider of products, services or procedures that may be referenced on the Platform.

THE PLATFORM AND THE CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. ACCESS TO, AND USE OF, THE PLATFORM OR THE CONTENT IS AT YOUR OWN RISK. NEITHER AESTHETE GENIUS NOR ANY AESTHETE GENIUS PERSONNEL MAKES ANY REPRESENTATION, WARRANTY OR CONDITION ABOUT THE QUALITY, ACCURACY, RELIABILITY, COMPLETENESS, CURRENCY, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR RELATED RIGHTS, OF THE PLATFORM OR THE CONTENT. NEITHER AESTHETE GENIUS NOR ANY AESTHETE GENIUS PERSONNEL ASSUMES ANY RESPONSIBILITY FOR ANY ERRORS, OMISSIONS OR INACCURACIES IN THE PLATFORM OR THE CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, AESTHETE GENIUS DISCLAIMS ALL WARRANTIES, REPRESENTATIONS AND CONDITIONS OF ANY KIND WITH RESPECT TO THE PLATFORM AND THE CONTENT WHETHER EXPRESS, IMPLIED OR COLLATERAL, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY AND RELATED RIGHTS OR THAT THE PLATFORM OR THE CONTENT ARE OR WILL BE ERROR-FREE OR WILL OPERATE WITHOUT INTERRUPTION. IN NO EVENT WILL AESTHETE GENIUS OR AESTHETE GENIUS PERSONNEL BE LIABLE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER LEGAL THEORY, FOR ANY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE DAMAGES, LOST PROFITS, LOSS OF USE, LOSS OF DATA, PERSONAL INJURY, FINES, FEES, PENALTIES OR OTHER LIABILITIES, WHETHER OR NOT AESTHETE GENIUS OR ANY AESTHETE GENIUS PERSONNEL IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM THE USE OF, OR THE INABILITY TO MAKE USE OF, THE PLATFORM OR THE CONTENT.

Copyright

Some of the Content is protected by copyright and other intellectual property laws. Except as granted in the limited licence referred to below, any use of the Content, including modification, transmission, reproduction or other exploitation of the Platform or its Content, whether in whole or part, without the prior written consent of Aesthete Genius, is prohibited.

Limited licence

You are hereby granted a limited, non-transferable, revocable and non-exclusive licence to access, view and use the Content for your personal, non-commercial use. Your are granted the right to download, store and print single copies of Content for your personal, non-commercial use provided that you maintain all copyright and other notices contained in such Content. You may not copy and/or repost Content online. You must also comply with any additional requirements governing the use of the Content as set out on the Platform.

Linking

The Platform may contain links to third-party websites. These links are provided as a courtesy to users and do not constitute an endorsement by us as to the goods, services or business of the operators of such third-party websites. Additionally, the content in any website to which the Platform links is not provided by or under the control of Aesthete Genius and if you choose to access any such website, you do so entirely at your own risk.

If you provide a link to the Platform from another website, we reserve the right to require you to disable such link.

Prohibited activities

You may not access the Platform or use the Platform or the Content in any way or for any purpose that is unlawful.

Without limiting the foregoing, without such consent, you may NOT engage in, or perform, directly or indirectly, any of the following activities with the Platform or the Content or any portion thereof:

No distribution. Making available, distributing, displaying, posting, disseminating, publishing, republishing, retransmitting, communicating to the public, or broadcasting;
No modification. Creating a derivative work, modifying, translating, selecting, arranging, merging, compiling or otherwise combining with other data or other content or framing from or on another website;
No scraping. Scraping, whether screen scraping, database scraping, or any other activity intended to collect, store, reorganize, summarize or manipulate any Content, whether by an automatic program or a manual process;
No transaction. Selling, licensing, sublicensing or engaging in any other commercial transaction relating to the Platform, the Content or any reproduction of all or any portion thereof in any medium; and
No decompilation. Decompiling, disassembling, reverse engineering or other exploitation of the Platform, its architecture or the underlying software or code.

Risks you assume

Access to, and use of, the Platform and the downloading of Content are done at your own risk. Aesthete Genius does not represent, warrant or guarantee that the Platform or the Content is compatible with your computer systems or that the Platform or the Content is or will be free of viruses, worms, trojan horses or disabling devices or other code that manifests contaminating or destructive properties or has harmful effects. You are responsible for implementing safeguards to protect the security and integrity of your computer system, and you are responsible for the entire cost of any service, repairs or connections of and to your computer system that may be necessary as a result of your use of the Platform.

Security

We cannot guarantee the security or confidentiality of any communications to or from the Platform.

Governing law and jurisdiction

The Platform is operated by Aesthete Genius from its offices in the province of Alberta, Canada. You agree that all matters relating to your access or use of the Platform and the Content as well as the interpretation of this Agreement shall be governed by the laws of the Province of Alberta and the federal laws of Canada applicable in the province. You agree and submit to the exclusive jurisdiction of the courts of the Province of Alberta with respect to all matters relating to any dispute that may arise under this Agreement.

Termination

We reserve the right, in our sole discretion, to terminate your right to use the Platform or the Content at any time and without notice to you.
